Terms of Service

 

TERMS OF SERVICE
By signing up for an Account you agree to the following terms and conditions.
These terms and conditions will continue in effect throughout your membership and after any termination, cancellation or expiration.

Please read them carefully.
These are the terms and conditions under which Moriboy / GarageCoLocation.com provides all Internet services ("service" or "services").
These Terms of Service act as a fully binding agreement between the company. ("Moriboy") and each the customer ("Customer" or "Customers").


1.Privacy Policy / Customer Information
1.1. Moriboy will keep all customer information private. No information will be given to any third party for telemarketing for sales purposes.
1.2. Moriboy will never sell, trade, or borrow personal customer information.
1.3. All customers must maintain the accuracy of their contact information with Moriboy.
1.4. If your account information can not be verified your account will be suspend and then closed.


2. Tech Support 2.1. Written Tech support will always be free either by e-mail or through our "IbizPanel" Case System.
2.2. Phone Tech support is limited to business hours.


3. Billing Cycle
3.1. Customers billing cycle will begin on the date that the account gets created.
3.2. Payments are due every month on the date the account was created or services added.
3.3. Moriboy dispatches e-mail invoices approximately five (5) calendar days prior to the due date.
3.4. If the account has an outstanding balance three (3) calendar days after the due date Moriboy will suspend the account.


4. Account Suspension / Reactivation
4.1. Moriboy will suspend the account if the customer still has an unpaid balance three (3) calendar days after the due date.
4.2. The account may only be reactivate after the balance is paid and may incur a twenty five ($25.00) dollar reactivation fee at Moriboy’s discretion.


5. Account Credits and Refunds
5.1. If Moriboy issues a refund. Moriboy will issue the refund to medium that was originally used.
5.2. When Moriboy offers a refund the customer has to choice to have the refund amount credited to the customers next invoice.


6. Account Payments
6.1. Moriboy accepts Master Card and Visa Credit Card Payments both through the "IbizPanel" and over the phone.
6.2. Customer may also mail in a check or Money order to Moriboy to our mailing address, but customer must send the amount to cover 12 months worth of service. Moriboy must have the check or money order posted no later then 3 days after the due date to prevent any interruption of the service.
6.3. Customer may also make a payment through Paypal within the "IbizPane") or by sending a payment to billing@moriboy.net . Customer must also e-mail billing@moriboy.net to notify us of payment and ensure that we have received the payment request.
6.4 Customer also can pay using the Auto-Pay feature. Credit Cards on file will be billed on the day the invoices are sent out.( 5 days prior to the due date). If you would not like to have your credit card set up for auto-pay. Please remove it from file. This will force you to manually add your credit card evey month to make a payment.


7. Cancellation
7.1. The customer can cancel at any time by either suspending the account through the "Ibizpanel"
7.2. Customers can also cancel by e-mailing billing@moriboy.net and including the account name and reason why 8 days prior to your due date. Upon receipt of the e-mail requesting the cancellation Moriboy will cancel the account on the next bill date unless stated other wise.


8. Domain Registration / Transfers and DNS Servers
8.1. Customer may register their domain with any Registrar ( i.e. RegisterFly, GoDaddy, Network Solutions and so many others) or they may elect to allow Moriboy register the domain.
8.2. Customer may choose to allow Moriboy to register the domain in behalf of the customer. Moriboy will register the domain through Srsplus. Moriboy will bill the customer annually on the date the domain name is registered.
8.3. Customer may elect to transfer the domain name to Moriboy from their current Registrar. Prior to doing so customer MUST contact their current registrar to ensure that a transfer is possible. Some Registrars and other Hosting Providers do not allow transfers to be done with informing them. If a transfer is requested and then denied by the other provider the customer will still be billed the Domain Registration / Transfer fee.
8.4. You must have your Domain Name Servers (DNS) pointing to ns1.moriboydns.net , ns2.moriboydns.net , and ns3.moriboydns.net if after 20 days of your domain name not resolving to our DNS Servers your account will be suspended and then closed.
8.5. If your domain expires you have 30 days to renew it. After 30 days your domain goes to the registrar and is put on a redemption period. During this redemption period you may renew your domain for a $200.00 redemption fee paid to the registar. After 60 days that your domain expired and you fail to renew it. Your domain becomes available to the general public to register.


9. No Refunds / NON REFUNDABLE
9.1. If at any time the customer violates any part of the Terms of Service. We have the right to cancel / suspend the customers account with out a refund.
9.2. If the customer has prepaid a set amount of months ahead of time. The customer forfeits such months and is not entitled of a refund if they violate any terms of our Terms of Service.
9.3. If a domain name transfer is denied by the other provider. The customer will still be billed the Domain Registration / Transfer fee and will not be refunded.


10. iHostFree.com Accounts
10.1 iHostFree accounts are given away AS-IS through the www.iHostFree.com web site.
10.2 Donations are no longer accepted.
10.3 iHostFree.com is not a Guarantee service.
10.4 iHostFree accounts have a 5.00 dollar set up fee for first initial account. Each additional account will have a 3.00 dollar set up fee.
10.5 To have the 5.00 dollar set up fee you must fill out the Verification Form and include a copy of a valid ID or Driver License. The form will only remove the 5.00 dollar set up fee. Each additional ihostfree account will continue to have the 3.00 dollar set up fee.
10.6 The Verification Form is valid only for United States and Canadian Residents. Individuals in other countries must still pay the set up fee.


11. New Terms of Service
11.1. When Moriboy updates or releases a new Terms of Service the Terms of Service will go into effect no later then 60 days after the updated / new Terms of Services is released.
11.2. The customer has no more then 60 days to go over the updated / new Terms of Service decide to accept them.
11.3. If the customer does not accept the updated / new Terms of Service the customer may terminate the account and get a refund if a refund is due.


12. Usage Guidelines
12.1. Customer is responsible for complying with United States federal, state, and local laws, and applicable laws of any other countries with which Customer uses the Internet to communicate. Customer may not participate in or support any illegal activities through the use of their service. Moriboy does not control the content of network traffic to or from their services or network.
12.2. Moriboy's services are provided as-is, and are to be used at Customer's own risk. Moriboy provides no warranties of any kind, expressed or implied, including warranties of salability or fitness for any particular purpose. Moriboy is not responsible for hardware or software damage, loss of wages or data, or any other financial or personal loss resulting from the use of, or inability to use, the service. Any liabilities are strictly limited to the amount of the fee(s) paid for services rendered.
12.3. Customer is responsible for all actions taken or caused to be taken in Customer's use of the service. As a condition of service, Customer agrees to indemnify and hold harmless Moriboy's officers, employees, agents, shareholders, and partners from any cause of action originating from use of the service.
11.4. Due to the insecure nature of much of the global Internet, Moriboy strongly suggests that credit card numbers or other personal information never be sent through e-mail or any other Internet service, unless proper encryption is used. Customer is fully liable and responsible for the security and integrity of their own services, including Internet servers. Moriboy will not be held liable for any security breaches that may occur. Customer agrees to fully indemnify and hold harmless Moriboy from any legal or financial claims that may result from a breach in the security of Customer's services.
12.5. If any portion of this agreement is found to contradict federal, state, or local laws, the remaining portions will remain in full force. Any and all disputes regarding or resulting from this agreement will be governed by the laws and courts of Los Angeles, California.
12.6. Moriboy operates under a strict "No Spam" policy. The sending of any unsolicited e-mail advertising messages from, to, or through Moriboy's services may result in the imposition of civil liability against the sender, in accordance with California Business & Professions Code Section 17538.45. A copy of the California Business & Professions Code may be obtained on-line from http://www.leginfo.ca.gov. "Unsolicited bulk" messages include, but are not limited to, commercial advertising, informational announcements, and political or religious tracts.
12.7. The Customer is responsible to make sure that all access numbers are local numbers before using them by calling their local telephone company to make sure. Moriboy can not be held responsible for any addition telephone charges the customer may receive from the telephone company.


13. The Following Activities are expressly prohibited
13.1. Sending unsolicited bulk e-mail (UBE) which advertises a Web site, e-mail account, or other service provided by or through Moriboy.
13.2. Making Usenet postings which advertise a Web site, e-mail account, or other service provided by or through Moriboy, to any newsgroup whose charter does not specifically allow such advertisements.
13.3. Sending (UBE) or posting advertisements to Usenet (except where specifically allowed by newsgroup charters) from a service provided by or through Moriboy.
13.4. Hosting "spam-friendly" Web sites, including spam software sites.
13.5. Harassment, whether through content, frequency, or size of e-mail or Usenet messages.
13.6. Sending e-mail to any person who does not wish to receive it. If a recipient asks to stop receiving email, the Customer must immediately and permanently cease to send that individual any further e-mail.
13.7. Forwarding or otherwise propagating chain letters or "e-mail hoaxes," whether or not the recipient wishes to receive them, unless such propagation is both solicited and in the clear context of debunking or discrediting chain letters/hoaxes.
13.8. Transmitting any electronic communication, including e-mail, using the name or address of another person or organization, for purposes of deception.
13.9. Impersonating another individual by altering source IP address information, or forging e-mail/Usenet headers or other identifying information.


14. The Following Activities are expressly prohibited (continue)
14.1. Any attempt to fraudulently conceal, forge, or otherwise falsify one's identity in connection with use of the service.
14.2. Any use of another party's electronic mail server to relay e-mail without express permission.
14.3. Collecting replies to messages sent from another Internet service provider, where those messages violate this Acceptable Use Policy or any applicable policies of the other provider.
14.4. Denial of Service, including, but not limited to, any form of Internet packet flooding, packet corruption, or abusive attack intended to impact the proper functioning of any party's Internet servers or services.
14.5. Using Moriboy's network, services, or systems to store or send content which is illegal according to the laws of United States of America, the state of California, the city of San Diego, or any International treaties respected by the United States of America, is not permitted for any reason.
14.6. Storing or sending any material deemed either illegal or inappropriate for our networks, including but not limited to child pornography, copyrighted images, software, or music, and spam-related materials including mass e-mail lists, is grounds for immediate termination of services. Note also that child pornography includes related material, such as simulated child pornography, non-nude child pornography, or sites linking to such material, whether it is determined to be legal or not. Offenses of this nature will be reported to the federal authorities and prosecuted to the fullest extent of the law.
14.7. Using or storing any type of software which is designed to or is likely to abuse or negatively impact Internet service, including, but not limited to, portscanners, hacking tools, ping flooding programs, security/root exploits, packet sniffers, and spam software.
14.8. Modifying, changing, or obscuring the MAC (Media Access Control) or IP (Internet Protocol) address(es) of servers or services. Doing so may be considered cause for service suspension or termination.
14.9. Intercepting or attempting to intercept, through any method, network traffic intended for other customers.


15. The Following Activities are expressly prohibited (continue)
15.1. Running proxy servers, such as squid or BNC, unless they are available only to users whose verified contact information is known by the proxy operator and can be disclosed to Moriboy or law enforcement authorities upon request. All usage of such services must be brought to the attention of the Moriboy security team and cleared by the Security Manager before you begin running such services.
15.2. Any previous or current behavior, such as the sending of unsolicited e-mail, that results in the addition of Moriboy to any e-mail blackhole lists, or otherwise negatively impacts the overall services of Moriboy, is grounds for termination.
15.3. All e-mail lists operated by our customers, either advertising resources on our networks or being sent through our networks, must conform to the double opt-in standards. Witch means user enters his/her e-mail address into the list operator's system. However, instead of immediate mailings being sent out, the e-mail list software sends out a confirmation message, asking for the user to confirm his/her addition to the list. If the user replies to that message, from the e-mail address that was signed up, he will be subscribed to the list. If the user does not reply to that message, he will receive no further mailings at all. This method drastically reduces the number of unwanted e-mails being sent to unhappy recipients, and that is why we require it for all e-mail lists operated by our customers.
15.4. For all Hosting Accounts the following items can not and will not be permitted to be hosted. Any MP3 mirrors, Cracks, Appz, Warez,Pr0n, .Bittorent list sites, Pornography containing Children and/or Animals. Files that break any Copyright laws, State or Federal Laws will not be allowed. If any of this files are found your hosting account will be terminated and files deleted.
